Visa & Work Permit: Application for Work Permit (Category A, Category B)

OBTAINING A WORK PERMIT IN CHINA: Categories A and B

(We take Shanghai Guidelines for foreign talents (Category A and B) as example, please note that the rules and the practice vary in different regions and cities).

Basic conditions of the employer
  • Established in accordance with law, with actual business premises, paying taxes and social insurance in accordance with law, and having no record of serious violations of law and dishonesty; the positions employed by foreigners should be with special needs, suitable candidates are temporarily lacking in China, and do not violate the relevant provisions of the State; and the wages and salaries paid to the foreigners hired shall not be lower than the local minimum wage standards
  • Where laws and regulations stipulate that it shall be pre-approved by the competent department of the industry, it shall be subject to approval
Basic conditions of the applicant
  • The applicant shall be at least 18 years old, in good health, have no criminal record, have a definite employer in China, and have the necessary professional skills or appropriate knowledge level for his work.
  • The work engaged in is in line with the needs of China’s economic and social development and is an urgently needed professional in China
  • Where laws and regulations have other provisions on foreigners working in China, those provisions shall prevail
  • Foreign high-end talents (Category A) refer to scientists, scientific and technological leaders, international entrepreneurs, specialized special talents and talents who meet the criteria of foreign high-end talents who meet the criteria of “high-precision and cutting-edge talents” and market demand-oriented, and meet the standards of foreign high-end talents with points (referring to applicants with a score of 85 points or above who have been scored by the “Integral Element Scoring and Assignment Table”). Foreign high-end talents are not restricted by age, education and work experience
  • Foreign professionals (Category B) refer to those who meet the requirements of the Catalogue of Guidance for Foreigners to Work in China and are urgently needed for economic and social development, with a bachelor’s degree or above and at least 2 years of relevant work experience, and are under the age of 60 Scores, applicants with a score of 60 or above) and the implementation of intergovernmental agreements or agreements, restrictions on age, education or work experience may be appropriately relaxed.
Required materials

Apply for the “Notice of Foreigner’s Work Permit” before entering the country

  • Application Form for Foreigner’s Work Permit in China: Fill in and print it online before entering the country, sign it (copy or fax), and upload it to the system with the official seal of the employer or the official seal of the department authorized by the unit.
  • Materials for the recognition of foreign talents: The applicant shall provide relevant supporting materials that meet the recognition conditions in accordance with the Classification Standards for Foreigners Working in China (Trial), the Standards for the Identification of Foreign “High-tech” Talents in Shanghai (Trial), and the Catalogue of Foreign “Urgently Needed” Talents in Shanghai (Trial), and the applicant shall sign the application form and affix the official seal of the employer, and agree that the licensing decision-making agency shall conduct supplementary investigation as needed. Those who meet the standards of foreign high-end talents (Category A) or foreign professionals (Category B) through point counting should provide the corresponding highest degree (education) certificate, vocational qualification certificate, Chinese proficiency (HSK certificate, etc.), income certificate of annual salary for working in China, proof of work qualifications, and point counting point table. Foreign high-end talents (Category A) or foreign professionals (Category B) recommended by the relevant departments shall submit a recommendation letter for applying for a foreigner’s work permit in China issued by the relevant industry authorities of Shanghai.
  • Proof of work qualifications: Proof of work experience related to the current position issued by the applicant’s original work unit, including position, working hours or projects that have been done, must be stamped with the official seal of the applicant’s original work unit or signed by the person in charge, and a valid contact number or email of the contact person shall be retained. Applicants who meet the criteria for foreign talents with points are required to provide a certificate of work experience that meets the number of years of points.
  • Highest degree (academic degree) certificate and certification materials: If the highest degree (academic degree) certificate is obtained abroad, it shall be authenticated by the Chinese embassy or consulate abroad or by the embassy or consulate in China of the country where the applicant obtained the degree (academic qualification) or China’s academic qualification certification agency; if the highest degree (academic degree) certificate is obtained in Hong Kong and Macao Special Administrative Region and Taiwan, it shall be authenticated by China’s academic qualification certification agency or notarized by the notary public in the region; if the highest degree (academic degree) certificate is obtained in China, only the original academic (degree) certificate shall be provided.
  • Relevant approval documents and professional qualification certificates: the approval documents or professional qualification certificates of the competent department of the industry shall be provided; the foreign professional qualification certificate shall be certified by the Chinese embassy or consulate abroad, or the original shall be notarized by the embassy or consulate in China of the country where the professional qualification certificate is obtained or notarized by a notary public in China; if the professional qualification certificate is obtained in the Hong Kong and Macao Special Administrative Region and the Taiwan region, the original shall be notarized by the notary public of the region where the professional qualification certificate is obtained.
  • Certificate of no criminal record and certification materials: foreign high-end talents (Category A), “urgently needed” talents (Category B) and scientific and technological talents(Category B) this item adopts a commitment system. Foreign professionals (Category B) shall be issued by the police, security, court and other departments of the applicant’s country of nationality or habitual residence, and shall be certified by our embassies or consulates abroad or foreign embassies and consulates in China (the place of habitual residence refers to the country or region where the applicant has left
    the country of nationality for more than one year and has resided continuously for more than one year, excluding China); The time of issuance of a clean criminal record should be within 6 months.
  • Physical examination certificate: The verification certificate of physical examination record or health examination certificate issued by the Chinese inspection and quarantine agency shall be issued within 6 months.
  • Employment contract or proof of employment: The contract should be provided in Chinese, which should be signed by the applicant and stamped with the official seal of the unit, and should not be altered. The employment contract or proof of employment (including the dispatch letter of the multinational company) shall include the work location, work content, salary, working hours in China, position, and the necessary contents of the seal page (signature).
  • Applicant’s passport or international travel document: the information page of the passport or international travel document. The passport must be valid for at least 6 months.
  • Applicant’s photo within 6 months: recent bareheaded electronic photo, white background, no frame, complete facial features, clear image, no spots, flaws, printing and ink defects.
  • Relevant supporting materials of accompanying family members: including the information page of the passport (or international travel document) of the accompanying family members, the certificate of family relationship (spouse: marriage certificate, children: children: children’s birth certificate or adoption certificate, parents or spouse’s parents: the applicant’s birth certificate or marriage certificate or notarized certificate), physical examination report (family members over 18 years old) and electronic photos (required to be consistent with the main applicant). Accompanying family members include spouse, children under the age of 18, parents and parents-in-law.
  • Other materials: materials to be supplemented by the licensing agency or decision-making agency as required.
