Working Visa Application Process

The Working Visa which we mention here actually includes a Work Permit issued by the Science and Technology Commission of Municipality (“STCM”) and a Resident Permit issued by the Exit-Entry Administration Bureau (“EEAB”).

Before Employee Arriving in China

Step 1: Registration of the Company

Register the company in the service system for foreigners working in China. It will take 5 working days after submission of the required documents.

Step 2: Lodgement of the “Alien Employment License Notification Letter”

Preparation and lodgement of the “Alien Employment License Notification Letter” with the STCM. The lead time is at least 15 working days after submission of application documents depends if the STCM has any questions about the applied documents. The “Alien Employment License Notification Letter” will be sent by email to the employee abroad.

Step 3: “Z” Visa

The employee needs to take the “Alien Employment License Notification Letter” and other required documents to the Chinese embassy/consulate in his/her home country or the country he/she currently resides to obtain a working (single entry Z) visa. The employee needs to confirm how long it will take with the embassy/consulate.

After Employee Arriving in China

Step 4: Physical Examination

Make appointments for the employee at the physical examination center. The report is expected to be obtained within 5 working days after the check and if no health problem.

Step 5: Apply for Working Permit

Apply for the “Working Permit” with the STCM. It will take 15 working days to get the “Working Permit” after receiving the physical check report.

Step 6: Apply for Residence Permit

Prepares and lodges the “Residence Permit” application for the employee with the EEAB. The employee will be required to present in person to the authority of the visa center for this part of the application.  It will take 7 business days to receive a “Residence Permit”.

Required Documents

  • Business License of the company.
  • Scanned copy of the passport/Chinese ID of the legal representative.
  • Personal information of an employee.
  • Office information of the company: Leasing Contract and Pictures of the office.
  • The Passport of the employee.
  • The 2” photo of the employee.
  • The latest resume (10 years) of the employee.
  • Highest diploma of the employee (at least university bachelor’s degree or above).
  • Notarized highest diploma.
  • Certificate of non-criminal record notarized by the Chinese Embassy/Consulate or the Foreign Embassy/Consulate in China.
  • Working Certificate for at least two years of experience related to the recruited position issued by the previous employer.
  • Scanned copy of the Z visa.
  • Official physical check report in China.
  • The original temporary residence registration certificate.

Yes. A company is allowed to hire an expat, wherever he/she is living in China or not now. However, the company shall consider some potential risks and issues:

  • It will bring difficulties if the employee is from a sensitive country.
  • The expat didn’t have 2 years of experience in similar positions.
  • The company didn’t rent a physical office.

Yes. The physical office is mandatory for a company to apply for a working visa for an expat. The police officers will have an inspection of the office when applying for a resident permit.

The highest diploma shall be notarized by one of the following institutes:

  1. Chinese Embassy/Consulate in the country where the university issued the diploma.
  2. The Foreign Embassy/Consulate of the country, where the university issued the diploma, is in China.

A certificate of non-criminal record shall be notarized by the Chinese Embassy/Consulate or the Foreign Embassy/Consulate in China.

The company is allowed to apply for resident permits for an employee’s kids and spouse. And the effective dates are the same as the working visa of the employee.

An expat is only allowed to be employed by a company in China. And he/she can start to work after obtaining a working visa. He/she cannot make money from other companies in China.
