Labor dispatching allows companies to scale up or down their  workforce amidst business uncertainties. This option allows them to avoid a severe penalties in term of unexpected termination and complexity of internal HR processing.

 As the official employer, the dispatching agency will take full charge of legal liabilities and administrative tasks of employment. 

How Does It Work?

Three parties will be involved in this labor dispatching model:

  • Dispatching agency (the Official Employer)
  • Dispatched employee
  • Company, registered in China, that the dispatched employees actual work for (the Ultimate Employer)

The  labor contract will be established between the dispatched employee and the dispatching agency. The company for whom the dispatching employee works for is considered as the ultimate employer.  The company supervises and manages the dispatched employee on daily work basis. The  dispatching agency takes  the rest of administrative tasks such as payroll, social contribution,IIT declaration etc. . The legal responsibilities are assumed by the official employer, that is the dispatching agency.

You just need to give one-month’ notification of the termination.

SINOVEST will manage the termination following the dispatching service contract agreed. You are not necessary to be involved in the process of termination.

 

The company shall find and decide which candidates that you want to hire, assign and manage the daily tasks of the dispatched employees, and pay for the service fee and labor cost.
